Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract.
To exercise your right of withdrawal, you must inform us
Email:
of your decision to withdraw from this contract by an unequivocal statement — for example by post or email. You may use the model form below for this, but it is not obligatory.
You can also exercise your right of withdrawal online using the “Withdraw from contract” button on our page amavi.dating/en/cancel. If you use this online function, we will send you without undue delay, on a durable medium (e.g. by email), an acknowledgement of receipt containing the content of the withdrawal statement and the date and time of its receipt.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we received the communication of your withdrawal. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Early expiry for stars
This section applies to stars you buy from us in the web app. For stars you buy in the app via Google Play, the section “Stars via Google Play” applies.
Stars are digital content that is not supplied on a tangible medium. Your right of withdrawal expires early when three conditions are met — as set out in Section 356(6) of the German Civil Code (BGB):
- You have expressly consented to us beginning performance of the contract before the end of the withdrawal period.
- You have confirmed your knowledge that by giving this consent you lose your right of withdrawal once performance begins.
- We have provided you with a confirmation of the contract on a durable medium.
In the web app we ask for the first two points with a checkbox before every star purchase, before we redirect you to PayPal for payment. The purchase cannot be triggered without this checkbox. We send you the confirmation immediately after the credit to the email address of your account; it contains the date, the service, the price, the order number, the payment method and the wording of your declaration.
If you do not tick the checkbox, no purchase comes about. A way of buying stars and keeping the right of withdrawal is not technically provided for: the stars are available immediately, and that is exactly what the consent refers to.
Subscriptions
This section applies to subscriptions you take out with us in the web app with PayPal or – where offered – by credit card. The next section applies to subscriptions via Google Play.
A subscription unlocks, for its term, the functions of the app that belong to your tier or add-on. They are available to you immediately after the first payment, without a tangible medium. For a subscription, too, your right of withdrawal expires early when the three conditions set out above for stars are met (Section 356(6) BGB): your express consent to us beginning the service before the end of the withdrawal period, your confirmation that you thereby lose your right of withdrawal, and our confirmation of the contract on a durable medium.
We ask for the first two points with a checkbox before every subscription: "I expressly request that you start the service immediately. I understand that I thereby lose my right of withdrawal for this subscription." In the web app the checkbox comes before we redirect you to PayPal or to the payment window for the credit card. The subscription cannot be taken out without this checkbox. We send you the confirmation of the contract after the first payment to the email address of your account; it contains the date, the service, the price, the term, how to cancel and the contract number.
If your right of withdrawal has not expired and you withdraw from a subscription, it ends with the withdrawal, and the section "Effects of withdrawal" applies to the reimbursement.
Subscriptions via Google Play
A subscription you take out in the Android app is bought from Google. The seller and your contractual partner for this purchase is Google Commerce Limited, 70 Sir John Rogerson's Quay, Dublin 2, D02 R296, Ireland. Google displays the price, bills it, collects it and remits the VAT. We unlock the functions of the subscription in the app as long as Google reports the subscription to us as paid.
The Google Play Terms of Service therefore apply to withdrawal, refund and cancellation of this purchase. You declare a withdrawal to Google, for example with a refund request in Google Play; whether and how much is refunded is decided by Google under its rules. If Google refunds a subscription, it also ends with us as soon as Google informs us.
Before a subscription via Google Play, too, we ask for the declaration quoted above with a checkbox in the app before we redirect you to Google Play.
Stars via Google Play
Stars you buy in the Android app are bought from Google. The seller and your contractual partner for this purchase is Google Commerce Limited, 70 Sir John Rogerson's Quay, Dublin 2, D02 R296, Ireland. Google displays the price, bills it, collects it and remits the VAT. We credit the stars to you as soon as Google confirms the purchase to us, and we provide the services you pay for with them in the app.
The Google Play Terms of Service therefore apply to withdrawal and refund of this purchase. You declare a withdrawal to Google, for example with a refund request in Google Play; whether and how much is refunded is decided by Google under its rules. If Google refunds a star purchase, we may debit the stars (terms and conditions, section 5.6).
Before a star purchase via Google Play, too, we ask for the declaration on the right of withdrawal with a checkbox in the app before we redirect you to Google Play, and we send you a confirmation by email after the credit.
Purchases via PayPal
In the web app you buy stars from us and pay via PayPal. The same applies to the right of withdrawal as above: it expires under the same three conditions, and the confirmation by email names PayPal as the payment method. If you are entitled to a right of withdrawal and exercise it, we refund the amount via PayPal.
PayPal's rules, for example its buyer protection, leave your statutory right of withdrawal unaffected. If a payment via PayPal is refunded or reversed, we debit the stars — in the case of a partial refund proportionately, rounded up to whole stars (terms and conditions, section 5.6).
